These General Terms and Conditions of Sale govern the purchase of products offered for sale through the website www.federicocantelli.com.

By using this website and placing an order, the Customer fully accepts these General Terms and Conditions of Sale.

ARTICLE 2 – SCOPE OF APPLICATION

These General Terms and Conditions govern all purchases made through the website www.federicocantelli.com.

ARTICLE 3 – PRODUCTS

The website offers perfumes, cosmetics and other products belonging to the brands distributed by Essenze&Poesia S.r.l.

All images displayed on the website are provided for illustrative purposes only and may differ slightly from the actual products due to technical reasons, photographic representation or packaging updates.

The essential characteristics of each product are described on the relevant product page.

ARTICLE 4 – PRICES

All prices displayed on the website are expressed in Euro (€) and include VAT, unless otherwise stated.

Any applicable shipping costs will be indicated before the Customer completes the purchase.

The Seller reserves the right to change prices at any time. However, the price charged to the Customer shall always be the price displayed at the time the order is placed.

ARTICLE 5 – ORDER PROCEDURE

To place an order, the Customer must:

Payments made via PayPal and Satispay are handled directly by the respective payment service providers. Essenze&Poesia S.r.l. neither stores nor has access to the full details of the payment methods used by the Customer.

The Seller does not store or have access to the Customer's complete payment card details.

ARTICLE 7 – SHIPPING

Orders are shipped via GLS Courier.

Delivery times are estimates only and may vary due to circumstances beyond the Seller's control.

Shipping is free for orders over €50.00, except for destinations where additional shipping charges apply, including islands where applicable and all countries outside Italy.

The risk of loss or damage to the products passes to the Customer upon delivery.

ARTICLE 8 – RIGHT OF WITHDRAWAL

The Customer, acting as a consumer, has the right to withdraw from the purchase contract without giving any reason within fourteen (14) days from the date on which they, or a third party designated by them (other than the carrier), acquire physical possession of the products.

Once the right of withdrawal has been exercised within the statutory period, all contractual obligations relating to the returned products shall cease.

ARTICLE 9 – RETURN OF PRODUCTS

The Customer shall return the products within fourteen (14) days from the date on which the withdrawal request was communicated.

The cost of returning the products shall be borne entirely by the Customer.

ARTICLE 10 – REFUNDS

Once the returned products have been received and inspected, Essenze&Poesia S.r.l. will process the refund, normally within 2–3 business days.

Refunds will be made using the same payment method used for the original purchase, unless otherwise agreed between the parties.

The Seller may withhold the refund until the returned products have been received or until the Customer has supplied evidence of having returned the goods, whichever occurs first.

ARTICLE 11 – LEGAL GUARANTEE OF CONFORMITY

All products sold through www.federicocantelli.com are covered by the Legal Guarantee of Conformity provided for under Articles 128 et seq. of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005), as amended by Legislative Decree No. 170/2021.

The guarantee applies exclusively to defects in conformity that existed at the time the product was delivered and become apparent within the period established by the applicable legislation.

In the event of a lack of conformity, the Customer shall be entitled, in accordance with the applicable law, to have the product brought into conformity by repair or replacement or, where the legal requirements are met, to an appropriate price reduction or termination of the contract.

To make a claim under the legal guarantee, the Customer must contact Customer Service at info@essenzepoesia.com, providing the order number, a description of the defect and, where possible, photographic evidence to assist in the assessment of the claim.

This guarantee does not cover damage resulting from improper use of the product, storage contrary to the provided instructions, normal wear and tear, accidental impact or use that is inconsistent with the intended purpose of the product.

ARTICLE 12 – PRODUCTS DAMAGED DURING TRANSPORT

Customers are requested to inspect the condition of the package upon delivery.

If the package shows visible signs of damage, tampering or alteration, the Customer is encouraged to accept the delivery with an appropriate reservation or, where appropriate, refuse the delivery and promptly notify Essenze&Poesia S.r.l.

Any damage or irregularity must be reported as soon as possible by e-mail to info@essenzepoesia.com, attaching photographs of both the package and the products received.

ARTICLE 13 – PRODUCT AVAILABILITY

Product availability displayed on the website is regularly updated but should be considered indicative only.

In exceptional circumstances, products may become unavailable after an order has been placed due to simultaneous purchases, technical errors or other unforeseen events.

The Customer is responsible for maintaining the confidentiality of their account login credentials.

Any activity carried out through the Customer's account shall be deemed to have been performed by the account holder.

The Seller reserves the right to suspend or terminate any account in the event of fraudulent, unlawful or unauthorised use, or where the Customer breaches these General Terms and Conditions of Sale.

The Customer's personal data shall be processed in accordance with the applicable European and Italian data protection legislation.

Any dispute relating to the interpretation, validity or performance of the contract concluded with a consumer shall be subject to the jurisdiction of the court of the consumer's place of residence or domicile, where required by the applicable legislation.

Essenze&Poesia S.r.l. reserves the right to amend these General Terms and Conditions of Sale at any time.
